What is a case management hearing (comparitie) in the Netherlands?
Dutch term: Comparitie | Legal basis: Article 131 Rv
A case management hearing (comparitie na antwoord) is a court hearing typically ordered after the exchange of the summons and statement of defence. Under article 131 of the Dutch Code of Civil Procedure, the judge can order a hearing at which both parties appear, present oral argument, and discuss the possibility of settlement.
The comparitie is the central hearing in most Dutch civil cases. The judge asks questions, explores the factual background, and often gives a preliminary assessment of the legal position. Settlement discussions frequently take place at or after the hearing. If settlement fails, the judge may order further written submissions, witness hearings or expert evidence.
Why it matters for international businesses
For international clients, the comparitie is often the first and most important court appearance. Proper preparation, including a clear understanding of the judge's likely questions and a realistic settlement range, is essential.
