What are opposition proceedings (verzet) under Dutch law?

Opposition proceedings (verzet) are the procedure by which a defendant who was judged in default can challenge a default judgment (verstekvonnis). The defendant files an opposition summons (verzetdagvaarding) and the case is heard on the merits before the same court that rendered the default judgment.

The opposition period is four weeks from the date of service of the default judgment, or from the moment the defendant became aware of the judgment if service was irregular. During the opposition, the default judgment is effectively suspended and the case proceeds as if no judgment had been rendered. The court may confirm, modify or reverse the default judgment.

Why it matters for international businesses

For defendants who have been judged in default, opposition is the primary remedy. Acting quickly within the four-week deadline is critical.
